Draft — awaiting legal review

This document is being finalised before launch and has not yet been reviewed by a lawyer. Passages in double brackets are still to be completed. Do not rely on it.

Why this page exists

French law requires anyone who publishes a website from France to identify themselves publicly, in a way any visitor can find without effort.

That identification duty now sits in Article 1-1 of the LCEN (Law no. 2004-575 of 21 June 2004 on confidence in the digital economy), where it was placed by the loi SREN of 21 May 2024; it was previously cited as Article 6 III-1, and many templates still are. The criminal sanction moved with it, to Article 1-2 LCEN — one year's imprisonment and €75,000 for an individual, €375,000 for a company. Article 6 still exists, but it now governs intermediaries (hosts and platforms), not the publisher-identification duty.

This page must be reachable from every page of the site — normally a permanent link in the footer.

DIGITSOLUTIONS was incorporated on 23 June 2023. Its principal registered activity is conseil en systèmes et logiciels informatiques (APE/NAF 62.02A).

HireCall operates the website at [[SITE DOMAIN]]. "HireCall" is a trading name (nom commercial) of DIGITSOLUTIONS.

Note for review — the name gap. Everything a visitor sees says "HireCall"; the contracting entity is DIGITSOLUTIONS. That is perfectly lawful, but it has to be stated plainly here, and it has consequences elsewhere: invoices, the DPA and the terms of service must all be in the name of DIGITSOLUTIONS with HireCall identified as the trading name, or customers will raise it in procurement. Two follow-ups worth taking now — declaring "HireCall" as a nom commercial at the registry, and checking that the HireCall name is free to use as a trade mark in class 42/35 and registering it. Neither is required to publish this page.

Note for review — RCS Rennes vs. "a Paris company". The registry shows RCS Rennes. The marketing positions HireCall as Paris-based, and the terms of service choose the courts of Paris. The jurisdiction clause is a valid choice between business parties and does not depend on where the siège is, so nothing here is unlawful — but the mismatch is visible to anyone who looks up the SIREN. Moving the siège to a Paris domiciliation resolves it.

Note for review. If HireCall carries on a regulated activity, is a member of a professional body, or holds any authorisation, Article 1-1 LCEN requires that to be stated here too. Activity code 62.02A does not suggest one. Confirm.

Director of publication (Directeur de la publication)

[[PUBLICATION DIRECTOR NAME]], in their capacity as [[PUBLICATION DIRECTOR TITLE]].

Note for review. For a company, the director of publication is by default its legal representative (the président of an SAS, the gérant of a SARL). Naming someone else is possible but must be a deliberate decision.

Host (Hébergeur)

The site is hosted by:

Vercel Inc. 340 S Lemon Ave #4133, Walnut, CA 91789, United States https://vercel.com

To confirm. Whether the contracting entity is Vercel Inc. (US) or Vercel Germany GmbH / another EU entity depends on the plan and the account. The address above must match the entity HireCall actually contracts with, and Article 1-1 LCEN expects a telephone number for the host. Confirm both from the Vercel account and the signed terms before publishing.

This also matters beyond this page: if the hosting contract is with a US entity, the website privacy policy must describe the transfer mechanism. See privacy.md.

Intellectual property

Unless stated otherwise, the content of this site — text, layout, graphics, the HireCall name and logo, and the underlying software — is the property of DIGITSOLUTIONS or is used under licence. Reproducing or reusing it beyond private use, or beyond ordinary quotation with attribution, requires our prior written consent.

Any trade names or logos of third parties shown on the site remain the property of their respective owners and are displayed for identification only.

To confirm. The landing page shows a customer logo strip and testimonial placeholders. Before publication, confirm that every customer whose name or logo appears has given written permission. Displaying a real customer's mark without consent is both a trade mark and a contractual problem.

Availability

We aim to keep the site available at all times but give no guarantee to that effect. We may change, suspend or withdraw all or part of it without notice.

Applicable law

This page and the use of this site are governed by French law. Any dispute falls to the courts of Paris, subject to any mandatory rule that gives a consumer the right to sue elsewhere.
